DLP has an extensive history of representing a full range of workers from police officers to those in construction, manufacturing and business. We represent employees who are injured on the job, who have claims for lost wages, medical treatment expenses and other claims against private employers, as well as local, state and federal agencies and workers' compensation insurers. We handle a complete range of employment needs including work contracts, termination contracts, harassment issues and job discrimination.
Workers' compensation laws are meant to ensure those that are injured or disabled as a result of their job are often provided with fixed awards thereby eliminating the need for litigation. These laws also may provide for dependents of those killed on the job. Workers' compensation is a matter of state law with Federal statutes being limited to federal employees. There also may be provisions for various types of jobs such as those under the Merchant Marine Act. Many factors, however, may complicate work-related problems which need to be analyzed by DLP.
The workplace has become much safer in the last decades. Although death from contact with machinery can happen as well as other problems such as slipping or falling, there is a range of responsibilities for employers to insure workplace safety. A century ago, workplace accidents were "cheap" with the attitude that the employee had assumed the risk as a condition of accepting the job. Where the employer could show that the injury was in part caused by the employee or a coworker, courts often would limit the liability of the employer. Because accidents were so cheap for the employer, American industrial methods developed with limited concern for safety. Usually, compensation amounted to no more than a half years pay.
